This Privacy Policy applies to personal information provided to Victory Health & Wellness ("Victory," "we," "us," or "our") through our services ("Services"), including the Victory Coaching App and any associated websites, applications, or widgets that link to this Privacy Policy.

This Privacy Policy explains how our Services process information relating to identified or identifiable individuals and households ("Personal Information"). "Process" refers to the collection, use, storage, and sharing of Personal Information.

Victory processes Personal Information on behalf of clients who use our coaching, training, or wellness services. Our clients include personal trainers, health coaches, studios, and wellness centers. We also process certain Personal Information for our own purposes, as described in this Privacy Policy.

Your Personal Information may be shared with third parties, such as your personal trainer or wellness coach. This Privacy Policy does not apply to third-party practices. We encourage you to review the privacy policies of any third parties you engage with through the Services.

We may revise this Privacy Policy to reflect changes in our data practices. The most current version will always be available on our website.

Note: Victory is not a covered entity under HIPAA, and our Services are not subject to HIPAA compliance.

• Account Information: Includes name, email, phone number, address, and Access ID (username and password).
• Fitness and Health Information: Meal plans, fitness routines, goals, health status, and related notes shared by you or your coach.
• Financial Information: Payment and billing information related to subscriptions or purchases.
• Commercial Information: Purchase history, service usage, and payment records.
• User Content: Includes messages, feedback, photos, and videos you voluntarily provide.

• Log Data: Includes login timestamps, app usage, navigation patterns, and device info.
• Location Information: Collected only with your consent.

• Connected Apps and Social Media: If you connect fitness apps (e.g., Fitbit, Apple Health) or social accounts, we collect permitted data.
• YouTube API Data: We may use YouTube API Services to display training videos within the app. Google’s privacy policy applies to any data processed via YouTube (https://www.google.com/policies/privacy).
• Profile Data: Includes analytics and inferred preferences to improve personalization.

We use your information to:

• Create and manage your Victory account
• Provide personalized coaching and support
• Improve and develop our Services
• Process payments
• Communicate updates, promotions, and support
• Monitor Service usage for quality and security
• Comply with legal obligations

You can opt out of marketing emails at any time, but we may still send you service-related communications.

We retain Personal Information for as long as needed to fulfill these purposes or as required by law.

We process data based on:

• Contract necessity (your subscription or use of Services)
• Legitimate interest

• Consent (when applicable)

We may share Personal Information:

• With your trainer or health coach
• With Victory-affiliated service providers (e.g., billing, IT support)

The Victory Coaching App is not intended for users under the age of 18. If we learn a child has submitted Personal Information, we will delete it. Parents can contact us to request removal.

• Object to data processing
• File a complaint with a data authority

We do not currently respond to "Do Not Track" or Global Privacy Control signals. We also do not sell or share your Personal Information for cross-context behavioral advertising.

We maintain physical, administrative, and technical safeguards to protect your data. You are responsible for protecting your account credentials. We cannot control how other users may use the information you share within the Services.

Your data may be processed in the United States or other countries with different data protection laws. By using our Services, you consent to such transfers, which will still be governed by this Privacy Policy.

California residents have the right to:

• Know what data we collect and how it's used
• Request deletion or correction
• Opt out of sale/sharing (Victory does not sell or share data for advertising)
• Non-discrimination for exercising rights
